TERMS AND CONDITIONS
The Client : The company or individual requesting the services of Rainbow Designs.
Rainbow Designs: Primary designer/site owner & employees or affiliates.
Designs will carry out work only for clients who are 18 years of age or above.

Copy of these terms and conditions must be signed by all new customers at the time of submission of work to Rainbow Designs, indicating agreement to and acceptance of these Terms and Conditions. Alternatively, payment of an advance fee or payment online is an acceptance of our terms and conditions, a copy of which is available here.

Rainbow Designs reserve the right to refuse to construct a web site which we may judge as unfit due to content or otherwise. This includes, but is not limited by, sites containing adult oriented material such as pornography, sites which promote hatred towards persons belonging to any ethnic group, religion or sexual orientation and sites which infringe copyright or are contrary to UK laws.

All material, both text and images, supplied by the client and used in the construction of the client's web site, will remain the client's property. All such material will be assumed to be the property of the client and free to use without fear of breach of copyright laws.

Rainbow Designs cannot take responsibility for any copyright infringements caused by materials submitted by the client. We reserve the right to refuse any material of a copyrighted nature unless adequate proof is given of permission to use such material. It is the customers responsibility to ensure that any web site is lawful, does not infringe any copyright or any other laws. It is also the customers responsibility to carry out any market research as to the viability and profitability of any project before accepting any quote.

Rainbow Designs will not be liable or become involved in any disputes between the site owner and their clients and cannot be held responsible for any wrongdoing on the part of a site owner. eg. Any disputes re content/images that have been provided to us for inclusion on the site.

The copyright for all material provided by Rainbow Designs , such as HTML code, graphics, photographs and text, will remain the property of Rainbow Designs until payment has been made in full, then they will became property of the client.

Rainbow Designs will make effort to design pages which display acceptably in the most popular current browsers, but cannot accept responsibility for pages which do not display acceptably in new versions of browsers released after pages have been designed.

If at any point during the web design cycle a client wishes to cancel, they may do so but will be required to pay an amount that Rainbow Designs judges to be proportional to the amount of work completed on the commission.

Deposit of 30% is required once a sketch is approved by client. Deposit is non refundable.

Once a website has been designed and completed the final balance of payment is then due in accordance with our payment terms. There are no exceptions to this, i.e If the client decides they no longer want the site, as they have commissioned the work and paid a deposit they are still obliged to pay for the work that has been done. Non payment will result in legal action being taken if necessary.

Rainbow Designs will initially place the client's web site on a demonstration server in order that the client may view and comment upon the project. Once the client has approved the project a final invoice will be presented. After the project is completed client is entitled to make up to 5 changes. Changes of layout are not allowed after the sketch is approved.

All assets must be supplied within 14 days of sketch approval. Rainbow Designs will make every effort to finish the project before the deadline agreed with client, but it will not take a responsibility for the delay if it was caused by the client. i.e supplying the assets. Rainbow Designs is a small business. To remain efficient it must ensure that work it have programmed is carried out at the scheduled time. On occasions we may have to reject other work and enquiries to ensure that your work is completed at the time arranged.
This is why we ask that you provide all the required information in advance. On any occasion where we cannot progress your website because you have not provided the required information when you have agreed to do so, and we are delayed as result, we reserve the right to impose a surcharge of up to 25%. If you agree to provide us with the required information and subsequently fail to do within four weeks of project commencement we reserve the right to close the project and the balance remaining becomes payable immediately.
Simply put, all the above condition says is do not give us the go ahead to start until you are ready to do so. NOTE: Text content should be delivered as a Microsoft Word (or similar) document with the pages in the supplied document representing the content of the relevant pages on your website. These pages should have the same titles as the agreed website pages. Contact us if you need clarification on this.
By agreeing to these terms and conditions your statutory rights are not affected. These Terms and Conditions supersede all previous representations, understandings or agreements. The payment of an advance fee or a deposit constitutes agreement to and acceptance of these Terms and Conditions.
